If the stays are slotted, you can loosen the bolts that fasten them to the rack and slide the rack up until it's straight and re tighten. Bending the stays is acceptable as well. I've done that lots of times when there was no other way to get the rack to sit level.
EDIT: I made the assumption that you have strap type stays. If they are the rod type, disregard my reply.
