Will courts really hold people to a new BAC of 0.05?

Most alcoholics started out drinking at young ages, so awareness might help with legal issues later on in life.

Most, but not all "no tolerance" laws are in effect for good reasons. I think the NYS position on under aged drinking is one of the better ones. Young people are very impressionable and want to mimic what they see adults do, but all too often, the results costs lives due to their lack of drinking experience and driving.
Then there are some that must have hidden agenda's.

There is at least one non-alcohol mouthwash on the market that I can recall...
PS Most alcohol tastes bad and if you have to tart it up with fruit (tomatoes are fruits as well) then you really want Kool-Aid.

I've never drank mouthwash in my life. Swished it around my mouth & spit it out, but never drank it.

I support people who choose to drink and NOT DRIVE. If you are going to use a substance that impairs judgement, you should make all transportation plans before you begin drinking. Sure there are some people who pace themselves and can pull off timing their drinks and are under the limit when they head home but I don't trust that many drinkers have that ability especially after drinking. Bottom line is don't drink and drive. Why is that so hard for people to live by?

For some, it's no different than texting and driving. They think they can do it safely. And for many people, if you wan to go out somewhere and enjoy dinner, music, etc., with drinks, you have to drive, sometimes long distances. People are not going to deny themselves.
I remember touring on the High Line in Montana while crossing the country. One day we stayed in a town with a movie theater and some bars and restaurants. The closest town to that one was 40 miles away. One guy in our group noted that if you wanted to see a movie or go out to eat, you had to drive 80 miles round trip. Having grown up in the big city, that was such a foreign concept to me, but it's reality for a lot of people.

I think (may not be correct, no experience with this) that NYS has a ZERO tolerance law for underage drinking. If you are underage and caught with ANY alcohol in your system, not only are you in trouble with the law, but so is the person(s) responsible. If you were drinking at someone's house (even without their knowledge and consent), they too will be charged with violations of the law.
Most alcoholics started out drinking at young ages, so awareness might help with legal issues later on in life.

True just as some people think there is no difference in effect/risk between driving while talking on a phone and staring into a phone screen to type and read messages while driving, others can't distinguish between driving after having a drink and driving while intoxicated.

Fyi-- for a 200 pound male, a BAC of 0.05 is more than 3 drinks (1.25 oz. of 80 proof liquor, 12 oz. of beer or 5 oz. of table wine) in an hour...

I don't have an issue with 0.05% BAC laws IF we also move to graduated violations, so those between 0.05 and 0.08 are charged with different violations and face different fines. IMO a 1st offense at the lower level should not be charged as a DUI unless there are aggravating circumstances, ie. an accident, or visible erratic driving as cause for the top.
We might make 2nd violations of even the lower lever more serious, ie. 2nd at 0.05 = 1st at 0.08.
My point is that we don't need to criminalize ever greater percentages of our population in an effort to make incremental improvements.

Also keep in mind, that I doubt that officers are stopping an breathalyzing people looking to snare anyone for trace amounts. It's extremely likely that anyone Breathalyzed in NYS is going to come in with readings higher than 0.01 or even 0.03%. That is unless erratic driving was cause for the stop and the low alcohol was incidental to whatever was the root problem.

Occasionally I have a drink with my wife AT HOME. No living person has ever seen me finish a beer. So I could literally fill any courtroom with friends and acquaintances willing to testify they have never seen me drink alcohol. Those who know me well socially would only be able to testify that I am adamant about not drinking if I am driving and have never seen me take a sip of booze if I were the DD.
It just isn't worth it.

I remember the crowd in high school that it was rumored drank mouthwash. We used to call them "burnouts"; imagine a kind of early proto-grunge look. Most of them are now either dead or in prison....
