Got hit by a Gatorade bottle

Got hit by a Gatorade bottle
Some of you remember me posting about going to court regarding the guy who threw the Gatorade bottle at me.
Well, ...the state couldn't meet the burden on the class 1 assault because I didn't sustain significant injury and the state didn't amend the officers initial charge...so, I got f-ed and the thug got off.
Because I didn't suffer significant damage to my bike, the criminal damage was dismissed...so, I got f-ed and the thug got off.
Criminal littering, Guilty and the the judge fined him $750. I feel ok about that.
The defense wanted the judge to drop everything because she felt my testimony wasn't credible and suggested I didn't know who threw the bottle or where it came from and that I was involved in a confrontation with the driver.
The judge said my testimony was compelling and very credible and that I did infact ID the D-head (ok, she didn't call him that).
So...some justice was served.
It's a shame, that someone can throw a bottle at a cyclist and this is what happens to them.
Makes me think next time...hmmm, should I just ambush this punk and serve out my own justice...no, not a chance, not worth losing my freedom for a useless oxygen thief f-stick.
Move forward, it's over.

Glad to hear he got something. Probably didn't expect to be out $750 + legal fees when he decided to be a *****hole. Way to go for taking him to court.

$750 and the guy having it on his record isn't "nothing". It's enough to hopefully get him to think twice before being a prick again but if it's really eating you all I'll say is "aircraft stripper". Draw your own conclusions.

Isn't there something you could have charged him with such as 'intent to cause harm'? I'm sure he would have felt felt a lot better had you fallen off your bike or the bottle lodged itself in your wheels causing you to fall and destroy your bike. They have intent to murder right? Why not this?

IF, you ever see this happen to anyone, get involved, step up, be a witness. The thought that thugs are winning the ever increasing criminal activity movement/fight is killing me.

Glad you at least cost him a few cases of Gatorade in fines and court costs. Not to mention his time in court.
I'd like to see states pass specific harassment legislation against drivers who harass cyclists verbally, physically or in a threatening manner with a vehicle. Like road rage legislation. Was there any kind of law like that this guy could have been prosecuted with in your state?

Well, there was some justice, the guy was dragged to court when he would be otherwise be home smokin up, plus is short $750, probably 1 month's worth of unemployment. Littering, eh, not the same as assault, but hard to be proven I guess. The burden of truth is on the court, and they couldn't produce enough to quell any doubts raised by the defense. Without knowing the specifics, sounds like a fair outcome considering the cirumstances.
I'd rather see a guilty man go with a slap on a wrist than an innocent man go down with a full punishment.
