If I copied/posted that E-Mail onto BikeForums. Appropriately in the "Pills&Ills"... what would BikeForum's response be? You'd likely get 1000 SPAM flags. The topic would likely be deleted, and I could be banned from the forum. What if I put it under Road Cycling?

Yet, this is unsolicited off-topic E-Mail sent out by Bike Forums, with an official "Bike Forums" Header.... And the response is to use our SPAM blockers, and click on "Remove Me"?

I guess I don't need to see the BikeForums "DealsLetter" and ads for a "New Wheelset" if you feel those should only be viewed if one also accepts off-topic pseudoscience.

I realize the official response is that advertising is out of your hands... BUT WHY IS THAT? Somebody is using your E-Mail lists, and adding your headers... and you would claim lack of oversight and control? Or did this garbage pass your internal review? Money trumps reason?
The community teams and sales teams are different. But ultimately, sales like these are how we keep the site free to use. The forums and email blasts have different rules and we can't enforce anything on the latter. think of it as jurisdiction. I can however bring up your concerns to them and that has worked before. For instance, a complaint about ads for firearms on a different site led to the banning of firearm ads on all sites in the department (except for one hunting-related site).

In regards to missing other emails, check the full email they come from. It may well be a different address. "@travel.ibemail.com" contains multiple addresses. It's just the domain we use for email blasts across the company, I believe.

It would appear that you've paid for bad advice, or that your legal team did not perform due diligence adequately. That's unfortunate, as it leaves you exposed.
You can be construed as doing business in the EU once you have EU citizens amongst your users, and you've got a responsibility under the Directive.

Your attempt a GDPR notice does not give site viewers the option of choosing what cookies are active on the site, required for an explicit opt-in of your viewers. Simply listing your desire to force cookie usage on viewers in order to view the site is a contravention of the GDPR as you're not allowed to withhold service based on the viewer's cookie management choices, your legal team should have made this clear to you. If they didn't, or if they have a differing interpretation, then it would appear they may need a reeducation on the subject.

Your advertising of your cookie policy as a defence is irrelevant for GDPR purposes as it does not allow an informed and explicit opt-in for the usage of the viewer's data.

The cookie policy also contravenes the Directive as it does not state how to opt-in, only how to opt-out - meaning you have designed things to be opt-in by default and that is a contravention.

Once I made it clear that I was an EU citizen and that I did not consent to my personally identifiable information to be used for 3rd party marketing purposes, and that I continued to receive 3rd party marketing material, that is also a contravention. It can be viewed as a data breach as a third party now has my data from this site without my explicit consent, and you neither inform me of exactly that nor requested my consent - and that's another contravention

I've no longer any need to contact your legal team about the issue, as it's perfectly clear that they haven't done their job correctly. It's not just the sales team that have GDPR responsibility - the data processor that gave the sales team the information also has failed their GDPR responsibility.

It'll be interesting to hear the responses from your legal team to my points as raised here.

IBJoel - emails are considered PII - and the spam emails show you've definitely given them to another group without consent. Doesn't matter if it's a parent company or whoever, if you've not gained explicit opt-in consent since GDPR came into force for the PII to be used elsewhere, you're in direct contravention.

As an aside, a clear and honest apology for the spam emails would also be useful, and entirely appropriate

True, or delete and ignore it. Although, it may also not be bad to provide feedback on what users find inappropriate.

After getting pounded with SPAM in the 1990's and early 2000's, to the point that several e-mail accounts became unusable, I have been very careful with the exposure of my current account.

And, so far for the last decade, I've been generally successful with limiting my exposure to malicious SPAM, to the point that I typically disable SPAM filters on my E-Mail providers.

If say I had two vendors that I was trying to decide which I wished to use, and one sent me instructions on how to purge my bowels... it would weigh heavily on the decision of continuing use of that vendor.

Yup, I got the empty your bowels spam email as well, which I immediately unsubscribed from. Problem is, what the heck does this have to do with bikes? We’ve been told our whole lives to eat certain fruits, vegetables, and whole grains to stay in good health.

I can't do anything without our legal team's say-so. If you do not contact them, there won't be a resolution. I'll bring it up to them myself, but I'm frankly not qualified as a paralegal.

You can quote GDPR up the ying yang but since that is addressed in a thread already that is all that was required. Please give it a rest, this has nothing to do with your getting into your settings and changing them properly. I realize you are in Ireland, I can see that. Now please stop whining. Okay, but GDPR doesn't apply to Australia even, it's not part of the European Union.

This is not an uncommon situation, it may surprise you but it goes with the rest of the site being supported by ads as well as memberships. The SIZE of this site requires it.

So I DO realize that the content of the ads is a bit silly some tines. That griping is CONSTRUCTIVE. There are ways to support BF and get rid of the ads as well. Let's find more of those. Okay?

They must first solicit your personal information before they can give it out!!!

Also, keep in mind, with hackers and scammers today, a company should store the least information that they absolutely need to store.

If I'm logged in and request to opt out... that should be sufficient.

I click on the "remove me" link and clicked the "unsubscirbe all" button in the last set of spam emails from this forum. I also unchecked all the boxes in the User CP that granted permission to send me emails from this forum.

WHY AM I STILL GETTING SPAMMED?

Not only do they not honour unsubscribe requests, but they are continuing to spam me at an email address that is not associated with my Bike Forums account. I changed my email address a while ago and they continue to send spam to my old email address. Not cool. And not defensible.

Hi, I'm looking into this. I don't know why people who have clicked "Remove Me" are still receiving these emails, it's not consistent with what I've been told.

OK guys, I got an answer for this: Basically because of the way/process our forum uses to communicate with our email client, a very small fraction of users who unsubscribe may receive subsequent emails (it appears that it's a total of 2 people out of nearly 200,000). That can also result in cases like Skippy's up there, where an old email address is used. PM me the email address at which you received the email and I will manually ensure you are taken off of the list.

Meanwhile, can SactoDoug please remove the hostile user title from his ID? This has to be against BF rules and is counterproductive if not pointless. IBJoel has done what he can to answer your questions and if the problem is resolved then I would ask that the thread be closed. Otherwise, somebody should PM staff and continue this offline.

I cannot speak to SactoDoug's title, but I can certainly understand his feelings, and he has a right to feel that way.
I also tend to blame these episodes on google getting out of hand. I've seen this before were they become overbearing with adds.
