Yes, that is pretty bad. No one should ever run bright red tires.

the bead is separating from the side wall. maybe if you ride at really low pressure and never lean or turn.....

Are we looking at those grooves along the edge? And the circles are to indicate that, along one stretch of the tire, the groove is continuous - and along the other stretch it is in a different pattern? It looks a little weird, but it does look like it is designed into the tire. I’m not really sure what to make of it.

I wouldn't worry too much. Ask the manufacturer.
I wouldn't have a problem with it myself unless closer examination showed more than just the outer layer being affected. The outer layer doesn't factor in with the physical demands of the tire other than to protect the inner parts. You can and will be right that it's not protecting that part of the tire casing. But when mounted and ridden, will that materially affect the life of the tire in that area?
If you are going to be ridding a max, no holds barred efforts................ maybe not the right tire.

I'm kind of going back and forth between these two POV's. One problem is I ordered the tire internationally, so returning may be a pain, if possible at all. Company hasn't wrote me back yet. Ironically, I wasn't even looking for a red tire, but it was all I could find in this particular brand/model. Everyone is out of stock of the black ones.

With those good pictures, and all of that split rubber - I can't imagine them not shipping a new tire, even without a return.

You'd think. Although I decided to read customer feedback after I ordered from them, and there are a lot of 1 star reviews with comments like "Sent me the wrong part and never responded to me and ruined my trip to Ireland and my marriage" so I don't have a lot of faith at this point.
