Am I getting robbed?

So I brought my 2007 Klein Attitude V Large in to a bike shop for a tuneup. The bike is in good condition and retailed for $1650.00 brand new. They tell me they dropped it and put a dent in the top tube that makes it unrideable, safety-wise. They offered to switch my components to a $379.00 Trek 820. Should I sue or am I way off base?

Sue? That seems a bit harsh. If they truly admit that they dented and ruined an otherwise good frame they should replace it with an "in-kind" type frame. That could be a used one or a new one but it should be an equivalent quality frame not a lesser one. That is just the fair thing to do. Will they do that for you?

The replacement frame need to be of similar value in my opinion unless they offer the repairs, upgraded parts, and swap free of charge to offset the difference.

If you were to get a warranty frame replacement from Trek for a Klein Attitude V, what would they provide? I'm pretty sure it would be nicer than a Trek 820. That's the level of frame the shop should be providing as a replacement.

The Trek 820 is kind of a low end bike, so I would not think that is an acceptable solution. IMO, they need to make the situation right, which means replacing with a comparable quality frame.

maybe they went with the 820 because that's all trek makes that has similar components.

The problem is that Trek no longer makes 26in frames other than the 820. What brakes does your Klein have, rim or disc?
The 820 frame doesn't have rear disc brake mounts, so it's not even clear that a 820 frame will work.

Getting a comparable frame would require moving to a 29er or 650b frame and fork. You basically need either a used frame or a new bike.

In short, yes you're being robbed. They should be required to pay you the depreciated value of your bike (that may or may not be $379). See what you can find on Craigslist and use that as a negotiating tool to get today's real value.

It depends on what you want. You're entitled to fair value, or a comparable replacement.

Shop for a used Klein to establish the value, then speak to the manager. OTOH - it might be that fair value is less than $400, and if so, and that Trek is worth that much than you may opt for it, though IMO, you'd want a new $400 bike, not s component swap onto the frame of a bike worth that much.

I certainly would not find that an acceptable solution. Perhaps the 820 is all that Trek has that would be remotely compatible, but then the solution would be to go with some non-Trek brand, or pay you the price of a similar quality replacement frame. Swapping an entry level hi-tensile framed Trek for a mid-level Klein (even one of the later mass-produced ones) is unacceptable.

Given the age of the bike that will be a significant knockdown. The best evidence of what the bike was worth is ads or offers for the same or a close match in the used bike market. Otherwise, the court may look at prices for comparably aged bikes that started at a similar price, to estimate how much bikes depreciate, then apply that reduction.

So, if he can negotiate something comparable or better, that's a sure deal vs. depending on a judge who might think that old bikes don't fetch more than a few dollars at yard sales.

I'm not sure if court is the best way but I'd defiantly try to get a different frame.
Assumming it's a reputable shop they should know the difference between the level of frame. Doesn't matter if they offer you a 2016 820 frame. Imo they're off. They best start looking for a frame for you

The OP''s bike is an almost 10byear old 26-inch aluminum hardtail that came with 9spd LX parts. Probably worth $300 to $500 depending on condition and if they upgraded any parts.

The shop can and should do better since they caused the problem, but money wise a $380 brand new bike isn't far off. If I were the OP I'd ask for a better frame, but truth is there aren't many options in the 26-inch hardtail range.

Why meet in the middle? That is normally a solution used when both parties share some responsibility, but in this case, the OP left an intact bike and the shop damaged it entirely through their own actions.

I'm not sure how accurate this is but bicycle blue book says your bike sold for $1,650 when new in 2007.

In 2007 that was a lot of bike and the 820 frame is a joke offer IMO. I think a fair deal would be to use the original MRSP of the Klein and the shop should let you put that cost towards a new bike . Give them the dented bike, they can sell the components on ebay.

One more thing, you are not required to take a replacement frame. You are entitled to be made whole which would mean cash and not merchandise.
