Well, judging by the quality of your writing, I'm sure you're an expert on the difference between premeditated and depraved mind murder. However, second degree murder is punishable by up to life in prison, so it hardly qualifies as giving him some sort of break. Proving premeditation (as opposed to just asserting it) is enormously difficult, "he pointed the gun and shot" is not enough.
