It's a contributory negligence issue. The article said they tried to stop the train, but didn't know of the truck on the track early enough to stop the train.

Lack of sparks don't mean brakes were not engaged.

I looked up the story, and found the crossing where this occurred (probably) . This is from the other side of the crossing. The sign is especially poignant.

the horn is just your last warning. it means the train driver has seen you but if you don't move it's too late. he's not stopping before he hits you, even if he slams on the emergency brakes.
