BUT, at the time of his plane crash - although he was not eligible/compliant for his PPL due to previous DUI, flying an experimental/LSA was legal - AND his post-crash blood-tox screen showed that he was NOT high/on drugs at the time of the crash. The Rutan Long EZ was a home-built, and as such had certain variations as to build parameters. One was the placement of the fuel selector valve. He had to reach over his shoulder to switch fuel tanks. YOU try that and not move the other hand (that is/was on the control stick) !! At that altitude and speed, it was less than a second or two...
