No, it's only unethical if I do more than like, but actually make love to his post after he tells me to stop. Or instead of unethical you could call it litter if I don't clean the post afterward and leave a mess all over his front yard (because the fence posts in his backyard are straight up hooches and I wouldn't touch them with a 10 foot pole for fear of getting a communicable disease).

Obviously.

In fact I'd argue it is a rider's responsibility to go over potholes rather then swerve around one if he sees it to late in order to avoid crashing their neighbour.

Eh, not necessarily. That's more of the referee electing to enforce/not enforce or fine/not fine. For example, if you get pulled over for speeding (say 70 in a 55) and you don't get a ticket, does that mean that 70 is now good to go?

Agree with that ^ re: ethics.

Unfortunately, it seems the lack of ethics has led to the development of these darn rules. Some are sticklers for them and some try to bend them in their own favor. I generally don't care and the liklihood of one of these mild rule infractions really affecting me is slim to none. I'm not in it to do more than enjoy competing. If I win great. If someone with a crinkled number beats me, they beat me (rules). If someone chops my wheel and beats me as a result, I'd be less than thrilled (ethics). If a Jr beats me on grown up gears, then kudos to them (rules and maybe ethics).
