+1. If it wasnt as advertised and you have proof...then the seller is at fault and you are entitled to something. If the seller wont negotiate a price, then Ebay and Paypal will probably say return the frame and the seller will refund the money.

There is a reason for this "bias", many sellers are just plain lazy if not dishonest. My last 2 scambay transactions: boots shipped were not the size listed, headphones missing all the accessories. Both sellers claim they are going to make good on issues but why do you have to go through all the hassle.

How many bikes or frames can you find on ebay right now that don't even have the frame size included in the listing? Hundreds.

I agree with the thoughts of the original poster; regardless of the condition of the frame or whether it turned out to be a better frame than she expected, the fact remains that she thought she was getting a 2010 frame. In my mind, there is a dollar amount that could make this whole situation a positive one; the seller would have been wise to have extended that offer.

The question in my mind is would anyone be upset if they purchased a 2008 frame and received a 2010 one instead?

This is all about one lousy little sticker. If the seller had had the good sense to remove it, we wouldn't be having this discussion about Phillip K. Dick or pcad's Ipad, nor would the OP feel violated. One lousy little piece of sticky paper. That's what this is all about.

Yep, that was my only option in the end, so I did it. Stinks when you've built your rep over ten years but your sales are minimal. It only takes one neg to bring it down.

I will say this was the only time I've encountered such a situation. This guy was determined to teach me a lesson. My final communication with him was: "I just left you positive feedback. Enjoy [the item]."

I don't disagree, but it really leaves sellers wide open to abuse, particularly the Power Sellers who are eBay's core. And the irony is that 99% of those sellers are very honest, it's their business.

I think you're correct and Trek's serial-number lookup is wrong. And this would be an important point because the lower headset bearing is different for '08s than for '09s and '10s. So if I were keeping this frame, I'd definitely do a reality check on the headset bearing socket to be sure, and then get the right bearings.

The plot thickens!

Right. It isn't a 6 series either. It will use the 53mm o.d. lower headset bearing, I guarantee it.
