Road Cycling “It is by riding a bicycle that you learn the contours of a country best, since you have to sweat up the hills and coast down them. Thus you remember them as they actually are, while in a motor car only a high hill impresses you, and you have no such accurate remembrance of country you have driven through as you gain by riding a bicycle.” -- Ernest Hemingway

When I was up at my uncle's, going through his rather unorganized boxes of documents, I came across a 2019 notice from Canada Revenue Agency.

"We have your tax refund of $1,000, and are applying it to your balance. You now owe $22,0000,000.00."

That's not $22 thousand, that's $22 million.

I had some vague notion that my uncle had run into issues as a developer way back, but I didn't know what happened. And to the extent I did know bits and pieces, I forgot.

So I have a mass of not well organized documents, plus the contact of his long-time accountant, and I'm trying to figure out what's going on.

Turns out that back in 1987-1988, my uncle (through his corporations), was involved in buying some land for a development. The land was held in a corporation. They decided it would be easier, faster just to buy that corporation, rather than the land itself.

Somehow, during the process, my uncle's lawyer screwed up and put my uncle's name as a recipient of the seller's shares, rather than his corporation.

A few years later CRA comes snooping around and eventually they charge my uncle with tax evasion/fraud for not properly reporting that transaction as income.

He had a criminal trial, the judge dismissed the charges because there was clearly no intent.

But apparently, in the eyes of CRA, the tax itself was still due. Something like $2.5 million in 1994.

I'm not sure what happened next, but later in the week I found a letter my uncle wrote (in 2017), claiming (1) he had never had a proper tax appeal hearing, and (2) incredibly, CRA statements from 2000 to 2013 did not show that tax liability at all. He had a 2000 and 2001 letter from CRA collections agent which says he owes $14,000.

Even after 2013, CRA didn't do anything at all to collect on the tax, other than take his tax refunds.

So here we are now wondering if the CRA is going to try to collect on this (which is obviously way more than the value of his estate) or what.

It looks like we're going to be consulting with a tax attorney in Toronto who deals with appeals to see if we can get this thing tossed.

tl;dr Velo Vol has a legitimate annoyance.

My mom is the beneficiary of whatever is in the estate. Plus, I'm annoyed that they did that to him.

That's not really an annoyance. It's stressful, but the price paid for playing big boy games and getting it wrong. You need a Canadian lawyer.

The taxman is famous for getting his, though, no matter what. Criminal charges for tax evasion being dismissed doesn't mean the tax wasn't owed, just that not having paid it wasn't criminal. It still wasn't paid, and needed to be paid, unless the debt was ruled invalid.

For example, if I am speeding and charged with street racing, but then prove there was no one else on the road to be racing against, I'm still speeding. Just not felony street racing.

Had to drop my Honda off for an all day appointment. Road home from north Peoria to south East Peoria. Some of it is a sucky trail but it does follow the river which is generally nice despite the humidity and haze. Stopped at the Dan Fogelberg monuments. Pardon the haze.

Had a nice long weekend of riding - kind of surprised myself by riding every day. Was nice but I'm pretty beat today and looking forward to taking the day off the bike.

Yesterday I finally went out to go ride some roads I've been wanting to get back on. It's been pretty hot here lately so I started at around 7 AM, but since I was in the mountains all day my Wahoo never registered any temperature above 75° until the very last few miles. The humidity was high, though, so by the halfway point I was completely soaked in sweat. Ended up with 55 miles and just over 5000', I briefly considered pushing it to a metric and over 6000' but the best option available to achieve that is a brutal climb that I hate doing on days that I'm feeling fresh, it's even more awful when you're already tired.

Lovely roads in NC:

Top of Mount Olivet at ~3000'. Typical hazy summer air.

Stopped my descent to move this little one. Got hissed at

Not sure how that is an annoyance. Beneficiaries are not entitled to anything, nor do they have an expectancy. It's a gift that is nice to receive, but nothing more. If there is something there, then that is fantastic, but if there is not then nobody should be upset.

My kids are beneficiaries under our wills, but if my wife and I spend our last dollar on our last day, then that's just the way it goes.

We had a weekend of warm weather - which felt hot because it's been so cold all Spring and so far into the summer. It was maybe 90 degrees tops on Sunday and it just felt deadly. But Monday and yesterday, the winds and the coolness returned.

Then our water heater broke. Luckily this was AFTER running the dishwasher and AFTER my shower (which I really needed because I'd spent a sweaty couple hours clearing weeds in what we jokingly call "The Back Forty".

Citizenship application process begun. It will not move forward quickly. Fortunately, for the most part, it will be done online. There are legends floating around saying that the folks who get in line at Immigration at midnight, don't make it through the door the following day.

Not sure it should come mainly from VV's uncle's estate, though.
