A start might be to charge the vehicle driver with an offense like this if they splatter a cyclist all over the road rather than changing lanes (where possible) to pass, instead of saying "have a nice day" when the motorists insists that they didn't see the cyclist.

Unless California makes a serious effort to educate drivers, for example running PSAs on TV, the law is meaningless as a safety measure. Charging people AFTER the fact doesn't make anyone less injured or less dead.
So, while it's a step in the right direction, it's a very tiny step and cyclists are still (and always be) in charge of their own safety.
I live in NY, where the vehicle code mandates full lane change to pass motorcycles, but neglects to include bicycles. Also, throughout the USA there's ambiguity about whether it's legal to cross a double yellow to pass slow moving vehicles (like bicycles). This needs to change and drivers told that it's both legal and recommended to do so when conditions allow it.
Laws are for lawyers, safety is about education --- for both bicyclists and motorists.
