Yes, call the police in Pinole CA and alert them. They have ways to ID the seller and catch him with the goods. Let us know how it turns out.

The tear is a little odd, but the top tube/down tube damage is very common with a hard front-end crash. The dents/crumples occur just beyond where the tubes are made thinner for double butted tubing (or in this case smaller).
It is possible the tear occurred during the original incident, or it is possible the bicycle remained rideable, and was ridden until the frame failed.
Buy the bike for the groupset. The fork and wheels may be usable. I don't see a lot of additional obvious damage.
Note:
I don't believe the downtube tear is complete, so the frame could not have simply slid off of a lock.

To me if it was an accident, I would look into a crash replacement with Trek, not sure if they have on the AL frames, but I that does seem odd.

How would one be able to discern the difference between stolen then crashed vs simply crashed by the owner?
Most warranty policies only cover the original owner. I don't know about Trek's Crash Replacement policy.

Locks or cables or chains are too easily cut with an battery powered angle grinder and a cut-off wheel.
I'd have to wonder why a thief would damage the bike. They have quite a bit of motivation to keep it in good shape I'd think. Much easier to sell and will sell quick which is good for both crooks and legitimate business.
I can see it as a wreck too that someone might have tried to pull out. Or just from the wreck itself.
Though at $375 for just the remaining maybe decent parts, that might be a crime if someone is foolish to pay that.

That damage is obviously the result of a crash. How do you make a crack all the way around a downtube? It's not a cut.
If you cut the downtube, the buckling in the top tube would be on the top of the tube, from pulling the down tube apart

If the frame was stolen, it would have been cut into tiny pieces and disposed of. And, parts flogged on E-Bay 6 months later, almost untraceable. Perhaps split, and trickle different parts up at different times.
The seller will take an offer. Hard to say what they'll accept.
Retail replacement cost of the groupset comes in above $700. Of course that is new. But, if the wheels are good, seat, seatpost, handlebars, and fork, then one could likely purchase, strip & flip, and still make money.
But, the seller also won't ship.

Does not look like a cut. There is no material missing where the saw blade cut. It looks like a tear

No fork damage? That's a lot of tube damage for the fork to be showing no ill effects. I guess it could have been replaced. Nice pedals.

The crack in the frame was caused by a small dent in the frame which grew larger from the vibrations and eventually gave way and broke. Other than the crack and small dent on the top bar of the frame, the bike runs very well and all other components are in good condition.
All components are original except the tires (Panaracer Pasela 700x28C). If you are someone who is looking to fix up and restore a bike, or just looking for parts, then this is the bike for you.

I'm no expert, but that doesn't look like a cut to me. The edges are too ragged. Looks more like damage from a crash. Plus if it were cut you likely wouldn't see the bending on the bottom part of the tube on each side of the break. I vote crash.

There probably was a dent in the downtube from the bike falling over on to something. Aluminum does not like to be dented, and if the dent is strong enough, it can crack and tear. So this all lines up with what the seller is saying.
But I think he is leaving out that the bike was probably crashed pretty hard straight on. That crash is what ultimately caused the downtube to tear like it did and to bend the top tube like it did. Carbon forks are amazingly strong, but I'll bet that one would fail an ultrasound inspection, and I'd bet the front wheel is far from true.

It wasn’t crashed. That frame damage was the result of clipless pedals and the overwhelming stopping force of disc brakes. In this case, it’s proper to call them disc breaks. You’re slipping, BF. This place used to be better.
